Important: By downloading, installing, or using the BabyKicks mobile application, you agree to be bound by these Terms of Use. Please read them carefully.
1. App Overview
BabyKicks is a mobile application designed to help expectant mothers track baby kicks and movements during pregnancy. The app offers kick counting, pregnancy progress tracking, timeline views, mother's feelings logging, smart reminders, and analytics features through both free and premium subscription tiers.
2. Subscription Services
2.1 Available Subscriptions
BabyKicks Premium offers the following auto-renewable subscription options:
- Weekly Subscription: $1.99 per week
- Yearly Subscription: $29.99 per year (Most Popular - Save 73%!)
Note: Prices may vary by location and are subject to change. Current pricing is displayed in the app at the time of purchase.
2.2 Subscription Features
BabyKicks Premium includes:
- Unlimited kick counting and tracking
- Complete pregnancy progress tracker with visual countdown
- Full timeline view of all baby movements and feelings
- Unlimited mother's feelings and mood logs
- Customizable smart reminder notifications
- Comprehensive analytics and kick pattern insights

2.3 Auto-Renewal Terms
Important Subscription Information:
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- Weekly subscriptions renew every 7 days
- Yearly subscriptions renew every 365 days
- You can manage your subscription and turn off auto-renewal in your device's Account Settings after purchase
3. Payment and Billing
3.1 Payment Processing
All subscription payments are processed through your device's app store (Apple App Store or Google Play Store). Payment will be charged to your app store account upon confirmation of purchase.
3.2 Price Changes
We reserve the right to modify subscription prices at any time. Price changes will not affect existing subscriptions until renewal, and you will be notified of any price changes in advance.
4. Cancellation Policy
4.1 How to Cancel
For iOS users:
- Open the Settings app on your iPhone or iPad
- Tap your name at the top
- Tap "Subscriptions"
- Find BabyKicks and tap it
- Tap "Cancel Subscription"
For Android users:
- Open the Google Play Store app
- Tap Menu → Subscriptions
- Find BabyKicks and tap it
- Tap "Cancel Subscription"
4.2 Cancellation Terms
- You can cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- You will continue to have access to premium features until the end of the paid period
- No refunds are provided for partial subscription periods
- You must cancel at least 24 hours before your renewal date to avoid being charged for the next period
- Your pregnancy data will remain accessible even after cancellation
5. Refund Policy
All sales are final. Refund requests must be made directly through your device's app store:
- iOS: Submit refund requests through Apple's Report a Problem website
- Android: Request refunds through Google Play Store customer service
BabyKicks does not control app store refund policies and cannot guarantee refund approval.
6. Free Trial (If Applicable)
If a free trial is offered, you will be charged the full subscription price when the trial period ends unless you cancel before the trial expires. Free trials are limited to one per user and are intended for new users to experience BabyKicks Premium features.
7. User Responsibilities
- Provide accurate pregnancy information (due date, start date) for tracking purposes
- Record kick counts accurately and honestly
- Maintain the security of your account credentials
- Use the app in accordance with these terms
- Not share your premium account access with others
- Not attempt to reverse engineer or modify the app
- Keep pregnancy information updated and accurate
- Use notification features responsibly
- Not input false or misleading pregnancy or kick count data
- Consult with healthcare providers for medical decisions
- Use the app as a supplementary tracking tool, not a replacement for prenatal care
8. Medical Disclaimer
Critical Medical Information:
BabyKicks is a tracking and journaling tool designed to help you monitor your baby's movements. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.
- BabyKicks does not replace prenatal care or consultations with healthcare providers
- Always consult your doctor or midwife about pregnancy concerns
- If you notice decreased fetal movement or have any concerns, contact your healthcare provider immediately
- BabyKicks cannot detect or diagnose pregnancy complications
- The app does not provide guidelines on "normal" kick counts — consult your healthcare provider
- Emergency situations require immediate medical attention, not app usage
9. Data Accuracy and Responsibility
Important Data Notice: BabyKicks relies on user-provided information for pregnancy tracking. Users are responsible for entering accurate kick counts, dates, and feelings. BabyKicks does not verify this information with medical professionals and is not responsible for any consequences arising from inaccurate data entry.
10. Kick Counting Disclaimer
- BabyKicks does not automatically detect or count baby kicks
- All kick counts must be manually entered by the user
- The app provides reminders but cannot guarantee you will remember to count kicks
- Analytics and patterns are based solely on the data you enter
- BabyKicks is not responsible for missed or uncounted baby movements
- Users must take action to contact healthcare providers if concerned about baby movements
11. Notification Services
BabyKicks provides notification services to remind users to count kicks:
- Notifications are gentle reminders based on user-set preferences
- Users can customize notification timing and frequency
- Users can disable notifications at any time through device settings
- BabyKicks is not responsible if notifications fail to deliver due to device settings or technical issues
- Notifications do not replace medical monitoring or healthcare provider guidance
12. Pregnancy and Health Information
BabyKicks does not access medical records or health systems:
- Users manually enter all pregnancy and kick count data
- No connection to medical records, healthcare providers, or health systems
- Users retain full control over what information is tracked
- All pregnancy data entered is for personal tracking purposes only
- Sharing data with healthcare providers is optional and controlled by the user
13. Analytics and Insights Disclaimer
Understanding Analytics Features
BabyKicks provides analytics showing patterns in baby movements based on your recorded data:
- Analytics are for informational purposes only
- Patterns shown are based solely on your manually entered data
- Analytics do not constitute medical advice or diagnosis
- Every pregnancy is unique — patterns may vary significantly
- Consult your healthcare provider to interpret any concerning patterns
- BabyKicks does not provide "normal" ranges or medical thresholds
14. Intellectual Property
Users retain ownership of their pregnancy tracking data and personal journal entries. BabyKicks does not claim rights to user-generated content. The BabyKicks app, including its design, features, and functionality, is protected by intellectual property laws.
15. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information, including pregnancy tracking data, kick counts, and feelings logs.
16. Termination
We reserve the right to terminate or suspend your access to BabyKicks at any time, with or without notice, for violation of these terms or any other reason. Upon termination, your subscription will be cancelled, but data stored locally on your device will remain accessible to you.
17. Updates to Terms
We may update these Terms of Use from time to time. Changes will be effective when posted in the app or on this page. Continued use of the app after changes constitutes acceptance of the updated terms. For significant changes, we will notify you through the app or email.
18. Limitation of Liability
Important Legal Notice:
BabyKicks and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the app, including but not limited to:
- Missed or uncounted baby movements
- Delayed medical intervention due to reliance on the app
- Inaccurate kick count data due to user entry errors
- Pregnancy complications or adverse outcomes
- Notification failures or technical issues
- Loss of pregnancy data due to device failure
BabyKicks is a tracking tool only and does not replace professional medical care.
19. Healthcare Provider Relationship
BabyKicks does not establish or facilitate any relationship with healthcare providers:
- We are not affiliated with any medical professionals or healthcare organizations
- We do not recommend or endorse specific healthcare providers
- We do not transmit data to healthcare providers without your explicit action
- You are responsible for all communications with your healthcare team
- BabyKicks does not verify or validate medical advice from any source
20. Third-Party Services
BabyKicks may reference or link to third-party pregnancy resources, healthcare information, or services. We are not affiliated with these services and are not responsible for their content, accuracy, or practices. Users should verify all medical information with qualified healthcare providers.
21. Technical Support
We provide technical support for app functionality, tracking features, and notification issues. Support does not include:
- Medical advice or guidance about pregnancy
- Interpretation of kick count patterns or analytics
- Recommendations about when to contact healthcare providers
- Diagnosis or treatment of any pregnancy-related conditions
22. User Content and Backup
While BabyKicks offers cloud backup features for premium users, you are responsible for maintaining your own backups of important pregnancy data. We recommend regularly exporting your kick count logs and journal entries for safekeeping.
23. Age Requirement
BabyKicks is intended for use by expectant mothers who are 18 years of age or older. Users under 18 should use the app under parental or guardian supervision.
24. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in the appropriate courts.
25. Emergency Situations
CRITICAL: In Case of Emergency
If you experience any of the following, contact your healthcare provider immediately or seek emergency medical care:
- Significant decrease in baby movements
- No baby movements for an extended period
- Any concerning changes in your pregnancy
- Bleeding, severe pain, or other pregnancy complications
DO NOT rely on BabyKicks or wait for app notifications in emergency situations.
26. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and BabyKicks regarding use of the application.
